Terms of Service

1. Acceptance of Terms

By accessing and using DojoBrains ("the Service"), including our mobile apps and related websites, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

If you are a parent or guardian enabling an account for a child under 13, you agree to these Terms on behalf of that child and confirm that you have authority to do so.

2. Description of Service

DojoBrains is an educational platform that helps students practise using quizzes, courses, flash cards, and related learning tools. Depending on your account type and entitlements, the Service may include:

• Educational quizzes, mock tests, courses, and flash cards
• Custom courses created from uploaded study materials (for example, photos of worksheets or textbook pages)
• AI-assisted generation of practice questions from uploaded or selected material
• Text-to-speech / audio playback for selected learning content
• Progress tracking, streaks, achievements, and optional leaderboards
• Guest (try-before-sign-up) access on a device, and registered accounts
• Age verification and parental consent features for users under 13
• Hearts or similar access mechanics, including options to earn access by watching ads where available
• In-app purchases: premium subscriptions and credit packs used for AI-powered features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

4. User Registration, Guest Access, and Accounts

You may use the Service as a guest on a device and/or by creating a registered account (for example via email or supported sign-in providers). You agree to:

• Provide accurate, current, and complete information when registering or verifying age/parental consent
• Maintain and promptly update your account information
• Maintain the security of your credentials and device access
• Accept risks of unauthorized access resulting from your failure to secure your account or device
• Ensure parental consent is obtained for users under 13

Guest accounts: Guest access may be limited (for example: device-bound progress, restricted purchases, or limited social/leaderboard features). Converting a guest account to a registered account may preserve eligible progress, subject to our technical and policy limits.

5. User Conduct and Uploaded Content

You agree not to use the Service to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, sexually explicit, violent, hateful, or otherwise inappropriate for children
• Upload materials you do not have the right to use (including copyrighted textbooks or worksheets beyond personal study use permitted by law or the rights holder)
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or related systems
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for commercial purposes without our express written consent
• Share inappropriate content or engage in cyberbullying or harassment
• Abuse AI generation, credits, ads, or other systems (including fraud, automation abuse, or circumvention of limits)

6. AI-Assisted Features

Some features use automated systems (including third-party AI, OCR, and speech services) to extract text from images and generate practice questions or audio. You understand that:

• AI-generated content may contain errors, omissions, or unsuitable phrasing
• Generated questions are for practice and learning support, not official exam materials
• Availability, quality, and credit cost of AI features may change
• We may refuse, filter, or remove uploads or generated content that violate these Terms or our safety rules

7. Intellectual Property Rights

The Service and its original content, features, branding, and functionality are and will remain the exclusive property of DojoBrains and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain rights in content you upload, subject to the limited license in Section 5. Generated practice content created by the Service for your account is provided for your personal educational use within the Service.

8. Payments, Subscriptions, Credits, and Ads

Some aspects of the Service are free; others require payment or credits. Offerings may include:

• Premium subscriptions: Benefits may include features such as an ad-reduced or ad-free experience, expanded access, or other entitlements shown at purchase time
• Credit packs: Credits may be consumed by AI-powered features (for example generating questions from uploaded pages). Credit costs may vary by feature or model
• Promotional credits: We may grant promotional or welcome credits that can expire or carry usage limits
• Ads and hearts: Where available, you may watch rewarded ads or use other allowed methods to earn limited access (such as hearts). Ad availability depends on region, age status, and platform rules

App Store and Google Play: Purchases made through Apple App Store or Google Play are billed by those platforms under their terms. Payment processing, taxes, renewals, cancellations, and refund requests for store purchases are generally handled by Apple or Google according to their policies. We do not control store refund decisions.

• Fees and entitlements are as presented at the time of purchase
• We may change pricing or pack contents prospectively
• Unless required by law or stated otherwise, fees are non-refundable by us directly for store purchases
• Subscription renewals may be automatic until cancelled in your store account settings
• Guest accounts may be unable to purchase until converted to a registered account
• Unused promotional credits may expire; paid credit rules are shown in-app where applicable

10. Educational Content and Accuracy

While we strive to provide useful educational content and practice tools, we cannot guarantee the accuracy, completeness, or suitability of all information, including AI-generated questions.

• Content is provided for learning and practice purposes only
• Users and parents should verify important information independently when necessary
• The Service is not a substitute for school instruction, tutoring, or official exam materials
• We may update or modify content and features at any time

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, DojoBrains:

• Excludes all representations and warranties relating to the Service and its contents
• Does not guarantee uninterrupted, secure, or error-free service
• Does not guarantee specific learning outcomes or exam results

12. Limitation of Liability

To the fullest extent permitted by law, DojoBrains and its officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Service. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.

13. Account Termination and Data Deletion

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, if you breach these Terms or misuse the Service.

• User-initiated deletion: Users can request account deletion through the app or by contacting support
• Data removal: Upon account deletion, personal data is removed or anonymized as described in our Privacy Policy
• Parental rights: Parents can request deletion of their child's account
• Retention: Some records may be retained where required for legal, security, fraud-prevention, or accounting purposes
• Purchases: Deleting an account does not automatically cancel store subscriptions; cancel through Apple or Google as applicable

14. Changes to Terms

We may modify these Terms at any time. If a revision is material, we will provide reasonable notice (for example in-app notice, website posting, or email) before the new terms take effect where practicable.

• Continued use of the Service after changes become effective constitutes acceptance
• Parents may be notified of material changes affecting children's accounts

15. Governing Law

These Terms shall be interpreted and governed by the laws of India, without regard to conflict-of-law provisions, unless mandatory consumer protections in your country of residence require otherwise. Courts in Kerala, India shall have jurisdiction, subject to applicable mandatory law.
